Major Changes in Virginia Employment Law that Every Employer Needs to Know
July 1st was the date that many big changes in
employment law went into effect in Virginia. During the legislative session earlier this year, attention was
concentrated on possible repeal of the right to work law (which failed) and the
increase in minimum wage (which was delayed).
But little attention was paid to some very far reaching new
statutes including significant broadening of whistleblower protection for
employees, limits on non-compete agreements, bans on discrimination on the
basis of hair styles as well as LGBTQ status, a presumption that workers who
perform a service for pay are employees, rather than independent contractors
and a new requirement that employees be provided with certain employment file
documents upon written request.
